Website Designs

Blue Horizon Design creates brand new and original websites for prospective Clients. Blue Horizon Design will not take over responsibility or hosting of a website designed originally by another individual or hosting company.

Blue Horizon Design will NOT design websites of a pornographic or explicit nature.
Blue Horizon Design will NOT design websites for the purpose of Hacking, Cracking, Warez or Internet Relay Chat (IRC).

Web Hosting

Blue Horizon Design recommends the use of Donhost Ltd hosting services for its website creation. Use of a different host will rest on the viability and practicality of Blue Horizon Design being able to successfully implement a website on the host in question, with the potential to provide all optional extras.

Blue Horizon Design reserves the right to terminate a project if the issue of the website host cannot be resolved.

Pricing / Payment

The price of building the Clients website will be determined by Blue Horizon Design and will be based on the specifications provided by the Client. Work will commence when the final design has been agreed along with the final price.

Blue Horizon Design will require payment of 25% of the agreed price upfront before work is to commence. Payment in FULL of the remaining amount will be paid when the Client is satisfied with the finished product. The final price of the product shall be what is quoted by Blue Horizon Design and agreed to by the Client before any work commences.

Blue Horizon Design will invoice the Client at any time after the product has been finalised and approved. If the Client fails to make any payment on the due date, then without prejudice to any other right or remedy available to Blue Horizon Design, Blue Horizon Design shall be entitled to:

Cancel the Contract or suspend any further deliveries to the Client
Demand payment of all outstanding balances whether or not due and / or cancel any outstanding orders from the Client
Appropriate any payment made by the Client to such of the Goods (or the goods supplied under any other contract between the Client and Blue Horizon Design) as Blue Horizon Design may think fit (notwithstanding any purported appropriation by the Client)
Charge the Client interest (both before and after any judgement) on the amount unpaid until payment in full is made

Guarantee

If a problem arises with the website as a direct result of the web design process, Blue Horizon Design will repair the problem at no extra cost to the Client. Blue Horizon Design will not be held responsible for the quality or condition of any content or materials provided by the Client for the website.

Blue Horizon Design shall have no responsibility for the accuracy of drawings, designs, layouts, patterns or specifications supplied by the Client. Modifications, additions or upgrades to the website after completion will be charged at a rate set by Blue Horizon Design and agreed by the client.

All personal data relating to the Client collected by Blue Horizon Design from which Blue Horizon Design can identify the Client may be recorded electronically under the Data Protection Act 1998, and will not under any circumstances be distributed to third parties.

Blue Horizon Design may also use the information provided by the client to occasionally notify the Client about Blue Horizon Design events, promotions or related activities that the Client may find useful.

Intellectual Property

All copyright, design right, trade mark rights, patent rights and rights in know how and other like rights whether registered or unregistered which subsist now or in the future ("Intellectual Property Rights") in the Goods, documents, drawings, specifications, designs, programmes or any other material prepared by Blue Horizon Design whether readable by humans or by machines devised or created by Blue Horizon Design shall vest in and shall belong to Blue Horizon Design free of any interest of any third party.

The Client shall not be entitled and agrees not to manufacture, reproduce, copy, simulate, emulate, modify, adapt, recreate, or use in original or translated form the Goods and any part thereof for any purpose other than that for which they were furnished, or do any other act inconsistent with Blue Horizon Design's ownership of Intellectual Property Rights.
